Office of Research Security (ORS) now files H-1B petitions for research center employees (Memorandum for Record). There are two different ways for H-1B petitions to be processed, outlined below. If you have any questions or concerns, please contact Caitlyn Schoenig.

 

USCIS requires a $460 filing fee for all petitions. First-time H-1B petitions require a $500 Fraud Prevention and Detection Fee. Premium processing costs an additional $2,500. Other fees may be applicable on a case-by-case basis.

 

***Processing timelines will be provided upon first contact with Caitlyn Schoenig. Timelines are estimated based on the Department of Labor (DOL) and USCIS current processing times and are subject to change.

 

ORS/In-House Filing

  • Applicant has to complete and submit the H-1B Information Request Form (attached) to ORS
  • Department/HR must provide the applicant's job information (including detailed job description/responsibilities, minimum job requirements, salary, and physical work location) to ORS
  • Department must complete the Export Control Attestation
  • ORS will submit the Application for Prevailing Wage Determination (form ETA-9141) to the DOL
  • Upon receipt of the ETA-9141 and the employing department's approval of DOL's wage determination, ORS will submit the Labor Condition Application (LCA) to the DOL
  • Upon certification of the LCA, ORS will post the LCA in two public locations for the required 10 business days
    • All USCIS fees (checks only) due to ORS at the time of posting
  • After the required posting time, ORS will submit the H-1B petition to USCIS

Counsel

  • ORS will coordinate with outside counsel to complete the H-1B petition
    • Caitlyn Schoenig will be the intermediary between UAH and counsel
    • The applicant and ORS will provide requested information to counsel
  • Counsel will complete the Prevailing Wage Determination
  • Counsel will submit the Labor Condition Application (LCA) to the Department of Labor
  • Upon certification of the LCA, the LCA must be posted in two public locations for the required 10 business days
  • Counsel will submit the H-1B petition to USCIS
